1. Introduction

Welcome to Realway Driver, developed by We Level Up Tech.

These Terms of Service ("Terms") govern your access to and use of the Realway Driver mobile application and related services. By downloading, accessing, or using the application, you agree to be bound by these Terms.

If you do not agree with these Terms, you must not use the application.

2. The Application

Realway Driver provides delivery drivers with tools to:

• Receive assigned delivery requests

• View pickup and delivery information

• Update delivery status

• Navigate to pickup and delivery locations

• Communicate with dispatchers and merchants

• Support daily delivery operations connected to the Realway platform

3. Eligibility and Account

To use the application, you agree that:

• You are legally eligible to work as a delivery driver in your jurisdiction.

• You will provide accurate, complete, and up-to-date account information.

• You are responsible for maintaining the confidentiality of your login credentials.

• You are responsible for all activities conducted through your account.

• We may suspend or terminate your account if we detect fraud, security risks, violations of these Terms, or other unlawful activities.

4. Driver Responsibilities

When using Realway Driver, you agree to:

• Comply with all applicable traffic, transportation, labor, consumer protection, and safety laws.

• Handle delivery orders responsibly and accurately update delivery statuses.

• Use customer information solely for legitimate delivery purposes.

• Not misuse location data, customer information, or delivery information.

• Maintain all legally required driver's licenses, vehicle registrations, insurance, and permits required by applicable law or your delivery operator.

5. Relationship with Merchants

Delivery requests are managed by merchants and platform operators connected to the Realway platform.

Unless expressly agreed otherwise in writing, We Level Up Tech does not employ delivery drivers on behalf of merchants and is not responsible for compensation, employment benefits, contracts, or working conditions between drivers and merchants.

6. Acceptable Use

You agree not to:

• Use the application for unlawful, fraudulent, or abusive activities.

• Attempt unauthorized access to accounts, systems, merchants, or servers.

• Reverse engineer, modify, interfere with, or disrupt the application or its security.

• Share your account credentials with others.

• Impersonate another individual or organization.

• Use the application in any manner that could damage, disable, or impair our services.

7. Location Services and Notifications

The application may request access to:

• Precise location

• Background location (during active deliveries)

• Push notifications

These permissions are required to support dispatching, navigation, delivery tracking, and operational communications.

You may manage these permissions through your device settings; however, disabling them may prevent certain features from functioning properly.

8. Intellectual Property

The application, software, trademarks, logos, content, and related materials are owned by We Level Up Tech or its licensors.

Subject to these Terms, you are granted a limited, non-exclusive, non-transferable, and revocable license to use the application solely for its intended purpose.

No ownership rights are transferred to you.

9. Privacy

Our collection and use of personal information are governed by the Realway Driver Privacy Policy.

By using the application, you acknowledge that you have read and accepted the Privacy Policy.

10. Disclaimer of Warranties

The application is provided "as is" and "as available" without warranties of any kind, whether express or implied.

To the maximum extent permitted by law, We Level Up Tech disclaims all warranties, including but not limited to:

• Merchantability

• Fitness for a particular purpose

• Non-infringement

• Availability or uninterrupted operation

11. Limitation of Liability

To the fullest extent permitted by applicable law, We Level Up Tech shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to:

• Loss of profits

• Loss of business

• Loss of data

• Loss of goodwill

• Service interruptions

arising out of or related to your use of the application.

12. Termination

You may stop using the application at any time.

We may suspend or terminate your account if:

• You violate these Terms.

• Fraudulent or illegal activity is detected.

• Continued access creates security or operational risks.

• We are required to do so by law.

Any provisions that by their nature should survive termination shall remain in effect after termination.
